A proposta que clarifica o reingresso de funcionários públicos na Caixa Geral de Aposentações (CGA) foi esta esta sexta-feira aprovada no parlamento, depois de ter sofrido alterações na especialidade para incluir mais trabalhadores. Em causa está uma proposta de lei que visa clarificar o regresso de trabalhadores à CGA que saíram posteriormente a 01 de janeiro de 2006.
Em 11 de julho, o Governo tinha aprovado, em Conselho de Ministros, um decreto-lei interpretativo sobre o reingresso de funcionários públicos na CGA. No entanto, o Presidente da República decidiu devolvê-lo sem promulgação, pedindo que fosse “convertido em proposta de lei ou proposta de lei de autorização legislativa”, de modo a “conferir legitimidade política acrescida” a um tema que “dividiu o topo da jurisdição administrativa e merece solução incontroversa”.
O Governo disse que iria seguir a recomendação de Marcelo Rebelo de Sousa e aprovou e entregou a proposta no parlamento, mantendo o mesmo conteúdo, mas durante a discussão na especialidade na Comissão de Trabalho, Solidariedade e Segurança Social foram aprovadas algumas alterações ao texto original.
De acordo com a proposta de lei, o diploma abrange “os subscritores que cessam o seu vínculo de emprego público após 1 de janeiro de 2006 e que, posteriormente, voltem a estabelecer novo vínculo de emprego público, em condições que, antes da entrada em vigor da Lei n.º 60/2005, de 29 de dezembro, na sua redação atual, conferiam direito de inscrição na Caixa Geral de Aposentações”.
Ou seja, tal como definido pelo decreto-lei original do Governo e que foi vetado pelo Presidente da República, estão excluídos os funcionários que saíram da Função Pública para o privado.

Propostas de alteração do PS e do PSD foram aprovadas. Reinscrição abrange trabalhadores que provem que interrupção do vínculo foi involuntária e que, nesse período, não tiveram actividade remunerada.
O Governo queria limitar a possibilidade de reinscrição na Caixa Geral de Aposentações (CGA) aos trabalhadores do Estado que transitaram de um serviço público para outro sem qualquer interrupção temporal. Mas com as alterações do PS e do PSD, aprovadas nesta quarta-feira, o regresso à CGA passará a abranger também os trabalhadores que demonstrem que a interrupção do vínculo foi involuntária, desde que, durante esse período, não tenham exercido actividade remunerada.
A proposta de lei do Governo, com as alterações do PS e do PSD, foi aprovada na especialidade nesta quarta-feira e a votação final global deverá ocorrer na sexta-feira.
Por proposta do PS (aprovada com os votos favoráveis dos socialistas, do PSD e do Chega), a reinscrição passa a incluir os trabalhadores que demonstrem que a interrupção do vínculo foi “involuntária, limitada no tempo e justificada pelas especificidades próprias da carreira em que está inserido”.
Miguel Cabrita, deputado do PS, destacou que a proposta assegura dois objectivos “fundamentais”. Garante que a convergência entre o regime de protecção social da função pública e a Segurança Social continua, mas: "Não ignoramos que houve um conjunto de incerteza que é importante que consigamos sanar”, disse.
A solução, exemplificou, responde aos professores admitidos no Estado até 21 de Dezembro de 2005 que, no final de cada ano lectivo, viram o seu vínculo cessar e, quando voltaram a ser colocados, passaram a descontar para o regime geral da Segurança Social.
O PSD votou favoravelmente a proposta do PS, mas acrescentou um novo ponto que foi aprovado com a ajuda do Chega (o PS, o BE e o PCP votaram contra). Assim, além de o trabalhador ter de demonstrar que a interrupção do vínculo foi involuntária, tem também de provar não ter “exercido actividade remunerada durante o período em que interrompeu o vínculo público”.
A deputada do PSD, Carla Barros, considera que a proposta do PSD “acautela” a situação dos professores e de outros profissionais “que fruto das especificidades da carreira interrompem o vínculo e depois retomam [funções]” e “a questão da gestão de recursos humanos e da retenção de talento no Estado, permitindo que trabalhadores possam sair, melhorar as suas competências e voltar”, mantendo a CGA.
A Lei n.º 60/2005, agora alterada, determina que a CGA “deixa, a partir de 1 de Janeiro de 2006, de proceder à inscrição de subscritores”. Assim, os trabalhadores da administração pública que iniciaram ou reiniciaram funções daí em diante passaram a ser inscritos e a descontar para o regime geral da Segurança Social.
A lei gerou várias interpretações e os tribunais têm vindo a apreciar centenas de processos de pessoas que descontavam para o regime da função pública antes de 2006, interromperam o seu vínculo ao Estado — muitos deles por apenas alguns dias — e que, quando retomaram funções, reclamaram o direito a voltar para a CGA.
A esmagadora maioria das decisões judiciais foi favorável aos funcionários públicos, nomeadamente professores. A generalidade dos tribunais entendeu que a lei apenas obriga a inscrever na Segurança Social os trabalhadores que iniciaram funções a partir de 1 de Janeiro de 2006 e não se aplica aos casos em que os funcionários já estavam inscritos e que, depois de um período de interrupção, retomaram o vínculo público.
Agora, passa a ficar claro que quem transitou de organismos ou serviços públicos, sem qualquer interrupção temporal, mantém o direito de inscrição na CGA. Nos casos em que o vínculo foi interrompido, o trabalhador tem de demonstrar que essa interrupção foi involuntária e que durante esse período não teve outro trabalho remunerado para poder continuar na CGA.
Esta deverá ser a interpretação a seguir pelos tribunais nos casos que não transitaram em julgado.
